These official rules (the “Official Rules”) shall govern all aspects of the below-described sweepstakes (the “Sweepstakes”).
NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN. MAKING A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.
First Federal Bank of Kansas City (the “Sponsor”) and these Sweepstakes are in no way endorsed or administered by EverFi. These Sweepstakes are not sponsored, endorsed, administered by, or associated with Instagram, Facebook, LinkedIn, or Twitter. Any information provided by you in connection with these Sweepstakes is provided to Sponsor, and not to Instagram, Facebook, LinkedIn, or Twitter.
1. ELIGIBILITY:
These Sweepstakes are open to all legal residents of the 50 United States and the District of Columbia who are 18 years of age or older at the time of entry. Void outside of the United States and where prohibited by law.
The following persons are not eligible to enter the Sweepstakes:
a) employees, agents, and officers of the Sponsor and any of the Sponsor’s affiliates and their subsidiaries, officers, agents, or employees;
b) officers, employees, and agents of any organization directly involved with these Sweepstakes, including any co-sponsor of the Sweepstakes;
c) any other company or individual involved with the design, production, execution or distribution of the Sweepstakes; and
d) immediate family members (spouse, parents and stepparents, siblings and step-siblings, and children and stepchildren) and persons living in the same household as any person identified in (a), (b), or (c) above.

3. SWEEPSTAKES ENTRY PERIOD:
The Sweepstakes shall begin on April 3, 2023 at 12:00 AM Central Time ("CT") (the “Starting Date”) and end on April 30, 2023 at 11:59 PM CT (the “Ending Date”). The time commencing upon the Starting Date and ending on the Ending Date shall hereinafter be referred to as the "Sweepstakes Period." The Sweepstakes will take place on the Sponsor’s EverFi Financial Education platform. All valid entries described below in Section 4(a)-(b) below (the “Entries”) must be received by the Ending Date to be included in the Sweepstakes. Entries received after the Ending Date will be void. Limit one entry per individual allowed during the Sweepstakes Period. The Sponsor will be the official time keeper for the Sweepstakes.
4. HOW TO ENTER:
There are two (2) ways to enter. An entrant can enter through either of the following methods:
a) Account Creation method: Automatic entry when individuals create a free account on our Financial Education platform and complete the course “Financial Literacy Month Contest.”
b) Enter by Mail: Legibly handprint your name, e-mail address and telephone number, the name of the Sponsor, and the word “Sweepstakes” on a 3” x 5” postcard and mail postage pre-paid to: P.O. Box 419194 Kansas City, MO 64141. All mail in entries must be postmarked during the Sweepstakes Period and received at the designated mail-in address no later than five days thereafter to receive one entry. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible or misdirected entries. Limit one entry per outer envelope. All entries become the sole and exclusive property of Sponsor and will not be acknowledged or returned. Potential winner(s) may be required to show proof of being the authorized e-mail account holder. All entries submitted via any other method will NOT be accepted.
Maximum Number of Entries. Irrespective of the method of entry, the maximum number of entries per individual for the Sweepstakes is one entry total. Use of any automated system to enter is prohibited and will result in disqualification.
5. ODDS OF WINNING:
Odds of winning the prize depends on the number of eligible entries received during the Sweepstakes Period.
6. RANDOM DRAWING:
On May 3, 2023, there will be a random drawing. There will be two (2) unique winners (the “Winners”) drawn from all Entries received during the Sweepstakes Period. The Winners will be notified as outlined in Section 9 below.
7. THE PRIZE:
The Winners will each receive one (1) pre-paid $250.00 USD gift card. Approximate Retail Value (“ARV”) of each prize: $250.00 USD.
The Winner must confirm their acceptance through email or phone call to the Sponsor by May 12, 2023 to avoid forfeiting the Prize and prompting a new winner to be randomly drawn pursuant to Section 9 below.
8. PRIZE RESTRICTIONS:
Prizes are nontransferable and may not be substituted or redeemed for cash by any Winner. The Sponsor reserves the right to substitute any prize for one of equal or greater value. Approximate combined retail value of all prizes is $500.00. All federal, state and local taxes and all other expenses not expressly listed in these Official Rules are the sole responsibility of each Winner, and a Form 1099 may be issued at year end of 2023. All federal, state, and local laws and regulations apply. Additional restrictions may apply. Sponsor shall only be responsible for awarding one single Prize to each Winner as stated in these Official Rules. THE SPONSOR EXPRESSLY DISCLAIMS ANY RESPONSIBILITY OR LIABILITY FOR INJURY OR LOSS TO ANY PERSON OR PROPERTY RELATING DIRECTLY OR INDIRECTLY TO THE DELIVERY AND/OR SUBSEQUENT USE OF ANY PRIZE AWARDED.
9. CLAIMING THE PRIZE:
a) Only a properly-claimed prize will be awarded. The Winner will be notified by email message or via phone call if the alternate method of entry described in Section 4(b) was used, on or about May 3, 2023 (subject to verification of eligibility and compliance with the terms of these Official Rules). Failure to respond to the initial verification contact within five (5) business days of notification may, in the Sponsor’s sole discretion, result in disqualification and a new potential prize winner may be selected by the Sponsor from all remaining valid entries. In addition, if any correspondence from the Sponsor is returned as undeliverable, the corresponding Prize will be forfeited and will be awarded to an alternate winner in a subsequent random drawing of all remaining valid entries. The Prize is deemed delivered when the Winner confirms their acceptance and shipping address or branch location in which they would like to pick up their Prize.
10. VERIFICATION OF POTENTIAL WINNER:
THE POTENTIAL SWEEPSTAKES WINNER MAY BE SUBJECT TO VERIFICATION BY THE SPONSOR WHOSE DECISION IS FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES.
Each potential prize winner must continue to comply with all terms and conditions of these Official Rules and winning is contingent upon fulfilling all requirements. The potential prize winners may be required to sign and return to the Sponsor, for the Sponsor’s receipt within five (5) calendar days of the date notice is sent, an affidavit of eligibility, and liability/publicity release (except where prohibited) in order to claim his/her prize. If a potential winner cannot be contacted, fails to sign and return the affidavit of eligibility and liability/publicity release, or if the prize or prize notification is returned as undeliverable, potential winner forfeits the Prize. In the event that a potential winner of a Sweepstakes prize is disqualified for any reason, the Sponsor may award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries.
11. PUBLICITY:
Except where prohibited, participation in the Sweepstakes constitutes each Winner’s consent to the Sponsor’s use of each Winner’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.
12. PRIVACY:
Information collected from entrants is subject to the Sponsor’s Privacy Policy. Please review the Sponsor's privacy policy here. By participating in the Sweepstakes, all entrants hereby agree to the Sponsor's collection and usage of their personal information and acknowledge that they have read and accepted Sponsor's privacy policy.
13. ENTRY CONDITIONS; RELEASE; DISCLAIMER OF WARRANTIES:
a) By participating in these Sweepstakes, all entrants agree to: (i) comply with and be bound by these Official Rules and the decisions of the Sponsor which are binding and final in all matters relating to this Sweepstakes; (ii) release and hold harmless the Sponsor, all co-sponsors, the prize suppliers and any other organizations and/or persons responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of the respective past and present officers, directors, employees, agents and representatives of any of the aforementioned individuals or organizations (collectively, the “Released Parties”) from and against any and all claims, expenses and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (iii) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an entrant’s participation in the Sweepstakes and/or entrant’s acceptance, use or misuse of any prize. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, entrant agrees that, by entering the Sweepstakes, (A) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prize awarded, shall be resolved individually without resort to any form of class action; (B) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorney’s fees; and (C) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
b) Additionally, by participating in these Sweepstakes, all entrants agree to release and hold harmless EverFi from any and all liability whatsoever and acknowledge that these Sweepstakes are in no way sponsored, endorsed, or administered by, or associated with EverFi.
c) Any Prize awarded hereunder is provided “as is” without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement.
14. LIMITATIONS OF LIABILITY:
The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, or programming associated with or used in the Sweepstakes; (b) technical failures of any kind, including but not limited to, malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error, which may occur in the administration of the Sweepstakes or the processing of entries; or (e) any injury or damage to persons or property, which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Sweepstakes. No more than the stated number of prizes will be awarded. If, for any reason, the Sweepstakes cannot be executed as planned, including, but not limited to, any governmental order, force majeure, social media mandate, printing, administrative or other error of any kind, transmission failure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Sweepstakes, or if the Sweepstakes is compromised or becomes technically corrupted in any way, electronically or otherwise, the Sponsor reserves the right, in its sole discretion, to cancel, modify or terminate the Sweepstakes and, if terminated before the original end date, to select the winners from among all eligible, non-suspect entries received through both entry methods combined as of the date/time of termination.
15. MISCELLANEOUS CONDITIONS:
a) Sponsor reserves the right, at its sole discretion, to refuse, disqualify, or withdraw any of the Entries at any time.
b) The Winners hereby consent to their names being published on a list of winners, unless otherwise prohibited by law. These Sweepstakes are independent sweepstakes. The Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond the Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by the Sponsor in its sole discretion. The Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law and, should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys’ fees) and any other remedies from any such person to the fullest extent permitted by law. The Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If a solution cannot be found to restore the integrity of the contest, Sponsor reserves the right to select a winner from among all eligible Entries received before canceling, changing, or suspending these Sweepstakes. Sponsor further reserves the right to correct any typographical, printing, computer programming or operator errors.
c) If any term or provision of these Official Rules is determined to be invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of these Official Rules or invalidate or render unenforceable such term or provision in any other jurisdiction. If any term of these Official Rules is held to be excessively broad or invalid, illegal, or unenforceable in any jurisdiction, it shall be reformed and construed by limiting and reducing it so as to be enforceable to the maximum extent permitted by applicable law in conformance with its original intent.
16. ARBITRATION; WAIVER OR JURY TRIAL; DISPUTES; CHOICE OF LAW:
Except where prohibited by law, as a condition of participating in this Sweepstakes, each entrant agrees that (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, including but not limited to prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association (“AAA”) and held at the AAA regional office nearest the entrant; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction.
To the extent that a matter cannot be resolved through binding arbitration, EACH PARTY HERETO IRREVOCABLY AND UNCONDITIONALLY WAIVES ALL RIGHT TO TRIAL BY JURY IN OR TO HAVE A JURY PARTICIPATE IN RESOLVING ANY DISPUTE, ACTION, PROCEEDING, OR COUNTERCLAIM, WHETHER SOUNDING IN CONTRACT, TORT, OR OTHERWISE ARISING OUT OF OR RELATING TO OR IN CONNECTION WITH THESE OFFICIAL RULES, THE SWEEPSTAKES, OR ANY PRIZE. Except where prohibited, each entrant hereby agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Jackson County, Missouri. Under no circumstances will any entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than entrant's actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and entrant further waives all rights to have damages multiplied or increased. Entrant further agrees that any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prize awarded shall be resolved individually, without resort to any form of class action. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Missouri, without giving effect to any choice of law or conflict of law rules (whether of the State of Missouri or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Missouri.
17. SWEEPSTAKES RESULTS:
To obtain the Sweepstakes’ results, mail a self-addressed, stamped envelope to “First Federal Bank of Kansas City Attn: Marketing – Financial Literacy Month Contest – Giftcard Winners”, P.O. Box 419194, Kansas City, MO 64141. All such requests must be received within 60 calendar days after the end of the Sweepstakes Period.
